BIOS, the owner and publisher of the website biosphoto.com operates as a photographic agency managing and distributing iconographic & photographic collections under commercial brand Biosphoto. Therefore the name “Biosphoto” used in the following Terms of Use, means the photographic agency department Biosphoto.
The site and all contents therein (texts, images, trademarks, logos, etc ...) are the exclusive property of Biosphoto, operating under the Biosphoto brand, or of its contractual suppliers who hold the intellectual property rights and are protected by French laws and international treaties and agreements on intellectual property.
Biosphoto reserves the right in its sole discretion to suspend without notice all or part of the services offered on the site, temporarily or permanently. Similarly, Biosphoto reserves the right to modify at any time the content and organization of the site.
The site is intended for research, viewing and selection of images from the photographic collections distributed by Biosphoto with the purpose of acquiring a license thereto for a specific use and for a limited term.
No transfer of intellectual property right is affected by viewing or downloading the photographs presented on the website; users are therefore not permitted to reproduce or represent them for any purpose whatsoever without entering into a proper license agreement with Biosphoto.
Any user performing a download or copy, by any means whatsoever, of the photographs represented on the site is deemed to have read and accepted Biosphoto’s Licensing Terms & Conditions.
Business users may register for a Biosphoto account, which grants them access to restricted sections of the website and to images download capabilities. The opening of an account requires the user to provide accurate and complete information enabling him to be identified and, where appropriate, to identify the company or other professional structure he belongs to.
Biosphoto reserves the right, that the user acknowledges, to temporarily suspend or permanently close, any previously granted account.
The user is responsible for the confidentiality of its access codes to the site and shall not transmit them to any third party whatsoever. The user is also responsible for all activities performed using his access codes and undertakes to notify Biosphoto immediately in the case of any unauthorized use of his account that he may become aware of.
The photographs on the site may be subject to restrictions as to the type of usage, duration or territory of licensing. They may also be subject to restrictions related to the moral right of authors. The physical availability of a given image on the website therefore does not imply its availability for licensing for a given use.
Such use restrictions may be specified from Biosphoto’s Licensing Terms & Conditions or be posted on the website next to the image, or be contained in the IPTC fields, or be notified to the user by Biosphoto when issuing a quote for the requested usage. The user agrees to abide by these restrictions and agrees to indemnify and hold Biosphoto harmless from any liability against all claims or lawsuits by third parties arising from their lack of compliance.
Any personal data that users may be required to communicate, especially in the context of applications for new accounts, is reserved for internal use and will not be forwarded to any third party, apart from Biosphoto’s contractors performing technical site management tasks or monitoring invoicing and payments. Similarly, transactions performed on the site by identified users are recorded, and Biosphoto retains the data for statistical purposes, and for monitoring and control of use of the images only.

Biosphoto will not be held responsible for any direct and indirect damage caused to any equipment of the user when accessing the site and / or resulting from its use.
Similarly, Biosphoto cannot be held responsible for the consequences of any interruption of service, or any difficulties encountered by the user when viewing or downloading photos, or any consequence of the connection to the Biosphoto website, including viruses.
